Terms & Conditions of Service

1. Eligibility

  • The loyalty scheme is open to individuals aged 18 or over.
  • One account per person.
  • Accounts are non-transferable.

2. Earning Points

  • Points are earned when visiting and spending at the fox and willow.
  • Points have no cash value.
  • We reserve the right to adjust earning rates at any time.

3. Sign-Up Bonus

  • New users receive a £10 sign-up bonus credited to their loyalty account.
  • The bonus may be subject to minimum spend requirements.
  • The sign-up bonus cannot be exchanged for cash.

4. Redemption Rate

  • Points may be redeemed at a rate equivalent to 4% of qualifying spend, unless otherwise stated.
  • Redemption is subject to availability and these Terms.

5. Redemption Blackout Dates

  • Points cannot be redeemed on the following dates:
  • 14th February (Valentine’s Day)
  • Mother’s Day
  • Easter Sunday
  • Father’s Day
  • 14th December - 2nd January (inclusive)
  • These dates apply every year and may be amended at our discretion.

6. Expiry & Misuse

  • Points may expire after a period of inactivity (if applicable).
  • We reserve the right to suspend or terminate accounts where misuse, fraud, or abuse is suspected.

7. Changes & Termination

  • We may amend or withdraw the loyalty programme at any time.
  • Reasonable notice will be provided where possible.
  • 8. Liability
  • We are not responsible for technical failures outside our control.
  • Nothing in these Terms limits liability where unlawful to do so.

9. Governing Law

  • These Terms are governed by the laws of Scotland, England and Wales.

This Privacy Policy explains how we collect, use, and protect your personal data when you use our loyalty application (“App”).

1. Who We Are

The App is operated by The Fox and Willow.

We use 5loyalty LTD (Company Registration Number: 10020833) as a data processor to provide loyalty app infrastructure and related services.

2. What Data We Collect

When you use our App, we may collect:

  • Name
  • Email address
  • Phone number
  • Loyalty points balance and transaction history
  • App usage data (e.g. visits, redemptions)
  • Device identifiers (where required for app functionality)

We do not collect payment card details through the App.

3. How We Use Your Data

We use your data to:

  • Operate and manage the loyalty scheme
  • Track visits and award points
  • Apply sign-up bonuses and redemptions
  • Communicate important account or reward information
  • Improve our services and App performance
  • Meet legal and regulatory obligations

4. Legal Basis for Processing

Under UK GDPR, we process your data based on:

  • Contractual necessity - to operate the loyalty programme
  • Legitimate interests - improving our services
  • Consent - for marketing communications (where applicable)
  • Legal obligations - record-keeping and compliance

5. Data Processing & Third Parties

We share data only where necessary.

5loyalty LTD (Reg: 10020833) acts as a data processor, processing personal data on our behalf under a data processing agreement.

We do not sell your personal data.

6. Data Retention

We retain your data only for as long as necessary to operate the loyalty scheme or comply with legal requirements. You may request deletion of your account at any time.

7. Your Rights

You have the right to:

  • Access your personal data
  • Correct inaccurate data
  • Request deletion
  • Restrict or object to processing
  • Data portability
  • Withdraw consent at any time
